To say that tort reform should not even be considered is the most ridiculous thing I have ever heard. You obviously don't understand that a significant amount of health care costs from practicing defensive medicine. Not the actual medical malpractice insurance costs. Certain lawyers (trial lawyers) are the number one reason our country is in the shape it is in. The thought that someone should have to pay for anything that goes wrong with somebody is ridiculous. No one wants to take responsibility for their own actions anymore. If physicians could just practice medicine based on the knowledge acquired over YEARS of education and not have to order every test under the sun for fear of being sued the cost of health care would decrease. Look what it has done in Texas. Why do you think Nancy Pelosi and the rest of the liberals in Washington are wanting to block Tort Reform. Wake up people before washington gets its wish and all the good doctors bail! I bet the people criticizing tort reform are the first to want to be seen ASAP and by the doctor they want. I feel sorry for the medicare patients if this bill passes. Their access to health care will go down not up...we better wake up!

Thank you Brendan for presenting the patients side. Tort reform cannot even be considered until there is quality reform. With 200,000 people dying from medical error and countless others injured doctors and hospitals should be grateful that the rate of malpractice claims is so low. The real criminal here is the insurance industry who will use any excuse to avoid payments to injured victims even in the face of obvious negligence. As long as hospitals successfully evade accountability patients must retain the right to hold providers individually accountable.
